TikTok Challenges EU’s Digital Markets Act Classification in Landmark Case
The EU Court of Justice is hearing TikTok's challenge against its designation as a 'gatekeeper' under the Digital Markets Act, marking the first corporate pushback against the bloc's tech regulations. The outcome could redefine Europe's ability to curb Big Tech dominance and foster market competition.
European regulators had grouped TikTok with Alphabet's Google, Meta, Apple, Amazon, Microsoft, and Booking.com in September 2023—all platforms with over 45 million monthly users. A lower court previously upheld the classification, dismissing TikTok's claim that it fails to meet all three gatekeeper criteria: market influence, essential business channel status, and entrenched position.
Noncompliance with DMA rules risks fines up to 10% of annual revenue. The case follows Apple's similar resistance, arguing the regulations compromise security and user experience. Legal observers note the proceedings may set precedents for how emerging platforms like TikTok are regulated alongside established tech giants.
